CONSTITUTIONAL AMENDMENTS

★ Three amendments that would permanently rewrite the Virginia Constitution ★
01
This is not about
“Reproductive Freedom”
It is about
ABORTION
WITHOUT LIMITS
Official Ballot Question

Should the Constitution of Virginia be amended to (i) protect the freedom of every individual to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; (ii) protect doctors, nurses, and patients from being punished for these decisions; and (iii) allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient's health is at risk or the pregnancy cannot survive?

WHAT IT DOES
  1. Creates a constitutional right to abortion for “every individual,” including minors.
  2. Allows one physician, without consultation, to determine if the pregnancy may affect the patient's physical or mental health in the third trimester.
  3. Protects those who aid or assist an abortion, opening the door for abusers and traffickers to facilitate abortions to destroy evidence.
✕
WHY VOTE NO
  1. Expands the constitutional rightCreates a broad constitutional right to abortion for “every individual,” including minors, at any stage of pregnancy.
  2. Third-trimester standardAllows one physician, who financially benefits from performing the abortion, to decide if the patient's physical or mental health is at risk — with no second opinion required.
  3. Protects those who facilitateProtects anyone who aids or assists an abortion, opening the door for abusers and traffickers to facilitate abortions to destroy evidence.
02
This is not about
“Marriage”
It is about
GENDER
IDEOLOGY
Official Ballot Question

Should the Constitution of Virginia be amended to (i) remove the ban on same-sex marriage; (ii) affirm that two adults may marry regardless of sex, gender, or race; and (iii) require all legally valid marriages to be treated equally under the law?

WHAT IT DOES
  1. Removes the ban on same-sex marriage.
  2. Affirms that two adults may marry regardless of sex, gender, or race. This separates sex and gender in the Constitution.
  3. Requires all legally valid marriages to be treated equally under the law.
✕
WHY VOTE NO
  1. Not about marriageGoes beyond marriage. Creates a gender ideology that separates sex from gender, and adds gender as a protected class in the Virginia Constitution.
  2. Undermines religious libertyForces the government and individuals to accept definitions of gender that conflict with deeply held beliefs.
  3. Future legal risksThis new language could be used in the future to expand legal claims based on gender identity, putting parental rights, educators, businesses, and organizations at greater risk.
03
This is not about
“Expanding Rights”
It is about
GIVING VOTING
RIGHTS TO CRIMINALS
Official Ballot Question

Should the Constitution of Virginia be amended (i) to provide for the fundamental right to vote in the Commonwealth, (ii) to revise the qualifications of voters so that a person convicted of a felony is not entitled to vote during his period of incarceration but is automatically invested with the right to vote upon release from incarceration, and (iii) to update the existing prohibition on voting by persons found to be mentally incompetent to instead apply to persons who have been found to lack the capacity to understand the act of voting?

WHAT IT DOES
  1. Establishes a fundamental right to vote.
  2. A felon cannot vote while incarcerated, but upon release from incarceration, voting rights are automatically restored without further action required.
  3. Changes the rule on mental competency to apply only to those who lack the capacity to understand the act of voting.
✕
WHY VOTE NO
  1. Automatic restorationAutomatically gives voting rights upon release from incarceration — no review of the crime or risk to public safety.
  2. Equal to the most serious crimesApplies regardless of the nature or severity of the felony, including violent felonies.
  3. Creates a constitutional rightLocks in “voting rights” as a constitutional right that can be used to challenge future election laws in Virginia.
